The Guanajuato Congress has still not voted since 2021 for the Equal Marriage initiative

The constitutional lawyer Miguel Carbonell publicly declared to the media during his visit to León, Guanajuato, which urges that the state congress take action and guarantee the principle of equality, because, ‘The entity continues to violate the rights of people from the LGBTTTIQ+ community and the Political Constitution of the United Mexican States, by not legislating on same-sex marriage,’ This is how Miguel Carbonell put it.

There are already several entities in Mexico, which have carried out reforms and changes, regarding equal marriage in the legislation of each federal entity. Lawyer Miguel Carbonell assured that the Supreme Court of Justice of the Nation compulsorily establishes that each federal entity has legislated equal marriage, those that still do not recognize it violate the constitution.

“That is a criterion that the Supreme Court of Justice of the Nation has already taken,” Miguel Carbonell commented.

In Guanajuato, the last proposal that was made to reform the civil code to allow equal marriage between people of the same sex was declared on September 30, 2021, before him State Congress. Before the bench last year, local deputy Gerardo Fernández addressed a few words to the court about the initiative.

“Although state congresses have the freedom to regulate the civil status of individuals, this power is limited by the fundamental rights to equality and non-discrimination, expressed in international treaties and the federal constitution. The law of any federal entity that considers that the purpose of marriage is procreation and that it must be celebrated between a man and a woman is unconstitutional. Gerardo Fernández, Local Deputy of the Green Ecologist Party of Mexico, expressed on September 30, 2021 in the Congress of Guanajuato.

The initiative has not been voted on to date and is still being analyzed by members of the Congress of the State of Guanajuato. On December 20, 2021, the Government Secretariat of Guanajuato issued a circular with which the civil registry is obliged to recognize same-sex marriage without the need to present an amparo to marry.

The circular bears the official number: 2261/2021. Since then, civil registries cannot prohibit same-sex marriage and do not require legal protection to marry.
